An adult Caregiver may enroll a child in school, whether or not they are related to the child or are the child's legal guardian. A Caregiver's Authorization Affidavit may be required for a caretaker to enroll a child in school. If you are having trouble getting a school district to accept the Caregiver's Authorization Affidavit, please call Legal Services for Children's Warm Line, Monday through Friday, from 1:3Opm - 5:OOpm, at (415) 863-3762.
Ask for the "Intake worker of the day" – if that person is busy with another caller, then ask to leave a message in the "intake voice mail." (Please note: Depending on the number of calls our office receives on any given day, LSC staff may not be able to return your call until the next day.)
There are some types of problems with which our office may not be able to help you. If that is the case, LSC staff will do their best to give you referrals to an agency that may be in a better position to assist.
A school district may require that a caretaker show proof that the caretaker lives in that district. This requirement should be reasonable and should not create an obstacle to enrolling the child.
If a caretaker would like a child to attend school in a district in which the caretaker does not live, the caretaker may apply for an inter-district transfer. If this request is denied, the caretaker may make an appeal to the County Board of Education.
The Caregiver's Authorization Affidavit law allows an adult caretaker to enroll a minor in school.
If the caretaker is a relative, the caretaker may also consent to medical care for the minor.
